Jack Fersko is Co-Chair of the Real Estate Department at the law firm of Greenbaum, Rowe, Smith & Davis in Woodbridge, New Jersey, where he also chairs the Alternative Energy & Sustainable Development Practice Group. Mr. Fersko’s practice reflects his extensive experience as a commercial real estate and general business lawyer. His legal services emphasize industrial and commercial real estate activities, sustainable development initiatives such as solar energy projects, urban redevelopment, financing, and the impact of environmental laws on commercial transactions. He has successfully negotiated many real estate agreements involving complex environmental transactional issues and related insurance agreements. He counsels clients on transactional issues and funding options related to green building and solar development and the impact of these initiatives on leases and other agreements, including the negotiation and drafting of Engineering, Procurement and Construction Agreements (EPC) and Power Purchase (PPA) Agreements. Mr. Fersko’s participation in high-value real estate transactions in New Jersey includes his leading a team of lawyers as real estate, land use and public finance counsel to a major private equity firm, his involvement in one of the largest portfolio sales of industrial real estate to be completed in New Jersey in recent years, and his key role throughout the planning, financing and construction phases of one of the country’s largest roof-mounted solar energy installations. Mr. Fersko is a Fellow in the prestigious American College of Real Estate Lawyers (ACREL). He is past Chair of the Land Use and Environmental Committee and current Chair of the Energy Subcommittee, past Chair of the Changes in the Profession Task Force, and a past member of the ACREL Board of Governors. Mr. Fersko is an active and prominent member of the commercial real estate community. He is a member of the National Association of Office and Industrial Properties (NAIOP), which honored him with its Industry Service Award (2006) and President’s Award (2005). Currently serving as co-Chair of the NAIOP-NJ Legal Committee and as a member of both the Energy & Sustainability and Legislative Affairs Committees, he is a former member of the NAIOP-NJ Board of Trustees. On the national level, he is a former Chair and past member of the NAIOP Environmental and Infrastructure Committee. Mr. Fersko also serves on the Executive Committee of Industrial and Office Real Estate Brokers (IOREBA). As a member of the American Bar Association Real Property, Trust and Estate Law Section, Mr. Fersko is Chair of the Government Submissions Task Force, past-Chair of the Section’s Leasing Group, and a member of the Green Leasing Task Force and Corporate Sponsorship Committee. He is also a member of the New Jersey State Bar Association, where he currently serves on the Renewable Energy, Cleantech and Climate Change Committee. Since the 1990’s, Mr. Fersko has been coordinating, moderating and lecturing at comprehensive annual seminars addressing a variety of transactional and leasing issues for the New Jersey Institute for Continuing Legal Education (NJICLE). Throughout his career, he has chaired and presented programs for numerous groups, including the ACREL, NAIOP, the American and New Jersey State Bar Associations and the International Council of Shopping Centers. Mr. Fersko has also been a guest lecturer at Monmouth University’s Kislak Real Estate Institute and has been invited to lecture at New York University and Columbia University’s graduate school real estate programs. Mr. Fersko is the editor of, and a contributor to, a two volume NJICLE treatise on “Commercial Real Estate Transactions in New Jersey.” He has written chapters on environmental insurance for the ABA publication “Brownfields – A Comprehensive Guide to Redeveloping Contaminated Property,” and on environmental issues in sales and leases for the “Commercial Real Estate Transactions Handbook,” Aspen Press, among many other publications. His article on “Insurance Issues Affecting Green Development” was published in Property & Probate magazine, a national ABA publication. Mr. Fersko is consistently selected for inclusion in Best Lawyers in America, is listed in and ranked among the Top 100 Lawyers in New Jersey Super Lawyers, and is listed in Chambers USA: America’s Leading Lawyers for Business and Who’s Who Legal: The International Who’s Who of Business Lawyers – Real Estate. He is Martindale-Hubbell Peer Review Rated AV® Preeminent. Mr. Fersko graduated from Marietta College and received his J.D. from Ohio Northern University.
